TO PREVENT POSSIBLE BUREAUCRATIC RED TAPE [BUREAUCRATIC DELAYS] IN THE ASSIGNMENT OF A FUNDED PENSION
Dear Elena Alekseyevna!
Federal Law No. 424-ФЗ "On Funded Pensions" of December 28, 2013, was adopted and is in effect in the Russian Federation.
This Law No. 424-ФЗ establishes the rights and obligations of citizens (interested parties, applicants) who intend to receive a funded pension.
I am an interested party, an applicant: I have duly transferred the required contributions to the Social Fund of the Russian Federation.
(For reference: from October 4, 2025, to October 9, 2025, V.V. Zalessky transferred 342,000 rubles in additional insurance contributions for his funded pension; on November 3, 2025, he transferred an additional 165,340 rubles; in total: 507,340 (five hundred seven thousand three hundred forty rubles) rubles in additional insurance contributions for his funded pension; all of these means, as of February 25, 2026, are under the jurisdiction of the Rostov Region Branch of the Social Fund of Russia.)
I also submitted two applications for a funded pension: on October 27, 2025, and on January 15, 2026.
Naturally, I did NOT view my actions as a form of online gambling with a deposit and with a conditional outcome.
I transferred the required contributions (507,340 rubles) and I was waiting for the assignment and payment (to me) of funded pension.
I received three letters from the Rostov Region Branch of the Social Fund of Russia:
(a) dated November 24, 2025, number ИП-61-01/47955л
(b) dated December 22, 2025, number ИП-61-01/50987л
(c) dated January 22, 2026, number ИП-61-01/54831л.
From these three letters, it follows that I am have a right for a funded pension.
However, the funded pension (for me) has not yet been assigned. A funded pension payments have not begun.
Even in online games, the participant is placed in a situation where they receive their results according to a certain logic. That is, the participant is given an explanation of why they receive a certain result.
In my situation, at the FIRST STAGE of reviewing my applications, I received responses denying the "lump sum payment." Two responses:
Dated October 27, 2025 - Notification (for payment case N 227315) (received by me on October 31, 2025) (from this Notification: (1) "Application 1031-219431 was not accepted because it is not the recipient." [???], (2) "An application for a lump sum payment of pension savings was previously submitted and approved." [?], (3) "The subsequent transfer of funds, in accordance with the established procedure, takes approximately two months." [?]),
Dated November 14, 2025 - Decision (N 409052/25) denying the lump sum payment of pension savings.
"Lump sum payment" and "funded pension" are the different concepts, the different notions. These two responses are simply strange.
After the first stage, the SECOND STAGE began.
During the SECOND STAGE, I received a legal position (response) (from the Social Fund of the Russian Federation), the gist of which was as follows. Certain actions must be taken with my contributions - from the side of the Social Fund of the Russian Federation. (I have virtually nothing to do with these actions, I have no influence on them, and they are not within my competence (jurisdiction).) It turns out that my legal rights and obligations to receive a funded pension depend on certain actions from the side of the Social Fund of the Russian Federation in relation of my contributions [507340 rubles].
This legal position allowed the Social Fund to defer the assignment [and the payments] of the funded pension (to me). The Social Fund took advantage of this opportunity. I received information that certain actions would be taken with my contributions, and these actions require time - three months (January 1, 2026 - three months - April 1, 2026). After analyzing the responses I received, I concluded that I needed to wait until April 1, 2026, and then submit another (third) application.
In online games, participants are typically given multiple attempts.
I had two main legal directions (options) for my actions- for the appointment and for receiving funded pension (to me):
(A) I could have based my legal activity on the applicant's rights and obligations-those rights and obligations established in Federal Law No. 424-ФЗ. With this a strictly legal approach, I could have counted on receiving the funded pension after submitting my application on October 27, 2025-that is, in October (or November) 2025. I, as an interested party and as an applicant, fulfilled all the conditions specified in Federal Law No. 424-ФЗ! But with this strictly legal approach, I would have been forced into a lengthy legal trial (dispute) against (with) the Social Fund of the Russian Federation-and such a trial (dispute) would have taken place under existing of a complex pension legislation as well with the citing (from the side of Social Fund) of (to) (towards) a certain state financial regulations and of (towards)a certain corresponding state financial interests.
(B) I could to "push aside", to "glance with a some correction at" the applicant's legal rights and obligations (my legal rights and interests) and to agree with the Social Fund's position, that is, to agree to the need to wait three months (after January 1, 2026), to wait until April 1, 2026. With this option, I would have to submit a third application after April 1, 2026, after which I would have grounds to hope for the appointment of the funded pension (to me) (in April 2026).
To reduce the time spent on trial (conflict) (controversial) activity, I decided not to take a strictly legal (based on a law) position and to agree with the position of the Social Fund of the Russian Federation: to submit a third application after April 1, 2026.
My wait until April 2026 is happening under the following circumstances: (1) the decisions of October 27, 2025 (in payment case N 227315) and November 14, 2025 (N 409052/25) to deny me the "lump sum payment" have not been called into question; (2) my rights and obligations as an applicant (applying for the legal assignment of a funded pension) are in dependence of the Social Fund's actions with my contributions [507340 rubles] - of actions that are not within my competence, on actions to which I have practically no relation, which are outside my legal rights and obligations.
In this situation, I am interested in the Social Fund of the Russian Federation using the remaining period until April 2026 (equal to approximately one month - March 2026) with maximum efficiency - so that after the beginning of April 2026, no new grounds are presented, exhibited, shown to me for postponing the appointment the funded pension (to me).
In view of the above, I ASK YOU to send a MP INQUIRY (REQUEST) to the Social Fund of the Russian Federation (119049, Moscow, Shabolovka St., Building 4, Bldg. 1): is the Social Fund taking all necessary steps to assign a funded pension to V.V. Zalessky after April 1, 2026?
