I read about an interesting criminal case in one of the online publications.
Two murders are considering in court. First, the defendant killed his common-law wife out of jealousy. After that, he was detained. In straitened circumstances, he (according to his statements) he became the object of threats from a cellmate. He killed a cellmate.
A photo is provided in the online material, and a melancholic comment is attached to the photo: the trial (process) brought together the injured parties (relatives of the common-law wife and relatives of the cellmate).
Under the "free mores" of modern Russia, a killing out of jealousy is almost an anachronism.
I began to recall the pre-revolutionary Russian judicial practice. If you read the short stories of Anton Chekhov, you can find a lot of indirect references to adultery in them. Nevertheless, an official morality was condemning an adultery, condescending to the crimes of the deceived spouses. The acquittals of jealous husbands who killed their adulterous wives were widely known.
With regard to the modern defendant, two major circumstances are against him. First, he killed his common-law wife with extreme cruelty. Secondly, the first murder was followed by the murder of a cellmate.
Nevertheless, if the second murder had not followed, then when considering as a separate case - the murder out of jealousy - the defendant would have had a real chance to hope that the court would take into account a mitigating circumstances.
The case of the famous woman-singer is now widely known. One of the important elements of this case is the reference to the famous woman-singer's actions in a state of a kind of clouded mind.
Did the above-mentioned man-defendant have any mental abnormalities at the time of the murder out of jealousy?
Simultaneously with the murder out of jealousy, a second murder is considering: the murder of a cellmate.
The reader of the online material sighs sadly: has a serial killer suddenly been discovered? Yes...
It's a bit of a strange move on the part of the accused (defendant) to kill his cellmate. (That is, a heavy accusation is above him, already; and he is worsening his situation more and more).
The defendant himself explains his action (the murder of the cellmate) by saying that he (the defendant) became the object of threats from a cellmate.
Yes.
But if he has become the object of threats, then the word-combination "legitimate self-defense" should appear (in the mentioned online material).
There is no such (or similar) word-combination in the online material. But there is an impression of the sudden discovery of a lurking serial killer (who has been hiding from justice for a long time).
The cellmate can't explain anything, because he's dead. If he (the cellmate) had been alive, it would have helped the defendant little: the cellmate (most likely) would have denied the threats. Thus, a comprehensive review of the second murder should be based on circumstantial evidence.
The reader of this online material, after the reflecting about the mentioned situation, gets the impression that in one court case - it is quite possible - two completely independent reviews (two different episodes) are combined.
Thus, the defendant's representatives have grounds to analyze the situation: should the side of defense to direct (to send, to hand) into the court of first instance (first level) and the courts of higher instances (higher levels) an argument: the two above-mentioned murders should be considered separately?
