ON ASSISTANCE IN ASSIGNMENT OF A FUNDED PENSION IN ACCORDANCE WITH THE ESTABLISHED PROCEDURE
Dear Olga Nikolaevna!
Federal Law No. 424-ФЗ "On Funded Pensions" of December 28, 2013, was adopted and is in effect in the Russian Federation.
I, V.V. Zalessky, have fulfilled all the requirements established by Federal Law No. 424-ФЗ "On Funded Pensions":
(1) I paid (in October - November 2025) contributions for a funded pension in the amount of 507,340 (five hundred seven thousand three hundred forty) rubles,
(2) I submitted (twice) applications for the assignment of a funded pension. (My applications were dated October 27, 2025 and January 15, 2026).
Three official letters from the Rostov Region Branch of the Pension and Social Insurance Fund of the Russian Federation confirm that I, V.V. Zalessky, have complied with all requirements established by the aforementioned Federal Law:
(a) dated November 24, 2025, number ИП-61-01/47955л
(b) dated December 22, 2025, number ИП-61-01/50987л
(c) dated January 22, 2026, number ИП-61-01/54831л.
My right to a funded pension is not disputed in any way!
From these letters and from the telephone conversations, I understand the situation as follows: three months are required, starting on January 1, 2026, and I must submit a third application after April 1, 2026.
I'm ready to wait until April 1, 2026, and to submit another [third] application after that date.
However, two circumstances are PREVENTING my waiting - without any worry - of the early April 2026:
(i) In response to my application of October 27, 2025, I received a response that it was denied to me in funded pension because I had received a "lump sum payment." However, "funded pension" and "lump sum payment" are different concepts. What should I have thought after receiving such a response?
(ii) None of the responses I received explicitly stated that I would be assigned a funded pension after I submitted my [third] application (after April 1, 2026). My understanding is the result of "deciphering" the responses I received. The wording in the responses seems clear, but at the same time, there are no direct guarantees.
As a result, I feel a sense of legal uncertainty. It seems I've done everything legally, transferred the necessary funds in the prescribed manner, but the results are being delayed. There's no complete clarity and certainty. Why not to assign me a funded pension "now" (right "today")-but to specify that accrual and payment will begin on April 1, 2026? This would be entirely logical and fair (if the three months are really the necessary period [for my waiting])-given that I've done everything required and have an indisputable right to a funded pension.
I, one of many applicants, am forced to study pension legislation.
I'm reading FEDERAL LAW No. 360-ФЗ of November 30, 2011, "On the Procedure for Financing Payments from Pension Savings."
In Federal Law No. 360-ФЗ, I find two interconnected legal provisions:
Part 5 of Article 3 of Federal Law No. 360-ФЗ mentions a situation when "the amount of pension savings... is less... than the additional insurance contributions for the funded pension"; - this is exactly what they're telling me: the contributions (507,430 rubles) exist, yes, they've been transferred to the Fund, but they haven't yet become pension savings; they haven't transitioned from one "state" to another; time is needed (three months? - until April 1, 2026?).
And Part 2.2 of Article 6 of Federal Law No. 360-ФЗ states that "in the case stipulated by Part 5 of Article 3 of this Federal Law, funds from the guaranteed replenishment transferred from the RESERVE of the Pension and Social Insurance Fund ..., and funds from the GUARANTEED COMPENSATION received by the Pension and Social Insurance Fund of the Russian Federation from the Deposit Insurance Agency, shall also be used to financially support the payment of the funded pension."
So, as I understand it, the current situation is perfectly regulated by law - even if contributions haven't yet become pension savings, it's no big deal; there are sources [financial means] for paying my funded pension!
In this situation, it turns out that there are [absolutely] NO grounds for denying me a funded pension.
This is what prompts me to ask you for assistance in protecting my legal rights to a funded pension.
I request that you contact the Pension and Social Insurance Fund of the Russian Federation (4 Shabolovka St., Bldg. 1, Moscow, 119049) with a proposal to re-examine the application of January 15, 2026 (submitted by V.V. Zalessky), for a legal and reasoned decision to appoint a funded pension for (to) V.V. Zalessky .
